A copy of FHFA's motion to dismiss a complaint filed by Richard Hornsby against Mel Watt landed on my desk this evening, and a copy is attached to this e-mail message for your reference.

Mr. Hornsby is not complaining about the Third Amendment.  Rather, Mr. Hornsby served as FHFA's COO, one unpleasant thing led to another, and Mr. Hornsby found himself unemployed.  The details about Mr. Hornsby's de-employment don't concern me.

What I find interesting is that the Department of Justice, rather than the legal team at Arnold & Porter, is representing Mr. Watt in this proceeding.  If the DoJ has represented FHFA elsewhere in any legal proceeding, I'm unaware of it.

I have more questions than answers because it is unclear to me what hat FHFA is wearing when.
