The Federal Circuit exercised its discretion today to deny the Fisher and Reid Plaintiffs' petition to prosecute a separate interlocutory appeal.  The Federal Circuit will permit the Fisher and Reid Plaintiffs to be heard in Fairholme's appellate proceeding, and a copy of the order memorializing the Federal Circuit's decision is attached to this e-mail message.
