Fairholme and the government don't object to Owl Creek and other amici submitting briefs to the Federal Circuit, but they don't want Fairholme's appeal to be held in abeyance for an indefinite period of time until Chief Judge Sweeney enters orders concerning the government's motions to dismiss all litigating shareholders' complaints.
