Judge Sleet published his Memorandum Opinion yesterday ruling that sec. 4671(f) of HERA blocks Messrs. Jacobs and Hindes' lawsuit, and a copy of the decision is attached to this e-mail message. I had the privilege of chatting with Gary Hindes following his participation on an Investor Roundtable at the 24th Annual Distressed Investing Conference yesterday in New York. I asked Mr. Hindes if he thought he'd take an appeal to the Third Circuit. "Oh, you betcha," he said without a moment's hesitation.
