Judge Kessler released her Memorandum Opinion and Order this afternoon telling Mr. Horsby she can't help him, his complaint is dismissed, and she'll let the Merit Systems Protection Board sort out his claims.  A copy of Judge Kessler's Opinion & Order is attached to this e-mail message.  Nothing in Judge Kessler's decision appears to relate to litigation challenging the Third Amendment.16-00517-0011
