Fairholme and the Class Plaintiffs filed a motion this evening asking Judge Lamberth to prevent FHFA, Fannie and Freddie from introducing six categories of documents at trial in October and prohibiting discussion of those six topics in front of the jury. A copy of that public filing is attached to this e-mail message. This evening’s filing provides some hints about how the parties want to mold and shape the evidence and argument Judge Lamberth will allow the jury to see, hear and consider when he asks that group to deliberate and render its verdict.
FHFA filed two additional motions under seal this evening, and those documents presumably ask Judge Lamberth to limit what the jury will allowed to see and hear.
