FHFA tells the First Circuit the Montilla Plaintiffs waited too long to bring the U.S. Supreme Court’s Collins decision to the appellate tribunal’s attention so their rehearing request should be rejected and the First Circuit’s conclusion that FHFA is not a government actor should not be disrupted.
