In a letter addressed to Judge Sleet today, Mr. Pagliara’s lawyers in Delaware urge the Court, once again, to consider and decide Mr. Pagliara’s remand request before addressing FHFA’s substitution request and before substitution decision, and, in the event that the Court wants to rule on substitution before remand, wait until a ruling comes from the D.C. Circuit in Perry v. Lew. Mr. Pagliara’s lawyers also direct Judge Sleet’s attention to a recent decision in Lightfoot v.
