Judge Sleet decided today that he won’t certify the questions Messrs. Jacobs and Hindes pose to the Delaware and Virginia state courts. Judge Sleet has decided, in light of Judge Lamberth’s decision, the answers to the questions Messrs. Jacobs and Hindes pose about the legality of a preferred security that vacuums up all of a company’s profits aren’t important.
