The Bhatti Plaiintiffs delivered their supplemental reply brief to the Eighth Circuit and a copy’s attached to this e-mail message. Shareholders and our government, clearly, don’t see eye-to-eye. The Eighth Circuit will request and schedule oral argument if it wishes or render a decision about how to proceed based on the written submissions. Nothing compels the Eighth Circuit to act quickly or to wait and see what happens in the Federal, Fifth and Sixth Circuits, Judge Lamberth’s courtroom or before Judge Schwartz in the Court of Federal Claims.
