Two petitions for writs of certiorari reached the U.S. Supreme Court last week. They are SFR Investments v. FHFA, No. 20-907, and SFR Investments v. M&T Bank, No. 20-908, and copies of those petitions seeking review of Ninth Circuit decisions in real estate foreclosure disputes are attached to this e-mail message. Both petitions ask the nine justices to answer whether FHFA’s structure violates separation of powers and, if so, whether its conservatorship of Fannie Mae and Freddie Mac must be set aside. I may be incorrect, but I don’t recall the Ninth Circuit being asked to invalidate the conservatorship proceedings. SFR Investments is asking the High Court to place both of its petitions on hold until it issues a decision in Collins.
