Highfields is content to sit on the sidelines while Fairholme pursues an interlocutory appeal in the Federal Circuit. Wazee tells Chief Judge Sweeney its derivative claims should proceed and the government should now be forced to respond
to all of the Wazee Plaintiffs’ claims.
