Washington Federal, the Fisher and Reid Plaintiffs, Owl Creek and the other litigating plaintiffs delivered joint status reports to Chief Judge Sweeney yesterday, and copies of three of them are attached to this e-mail message. All of the shareholders want Chief Judge Sweeney to rule on the government’s motion to dismiss as it related to their individual complaints, and all of the plaintiffs want to take an appropriate appeal to the Federal Circuit at this juncture. For varying reasons, the shareholders don’t think an interlocutory appeal from the Dec. 20 opinion entered in Fairholme’s case will be adequate. The government says a dozen appellate proceedings before the Federal Circuit won’t work. .
