Treasury filed its brief this evening, and a copy of that filing is attached to this e-mail message. Treasury tells Judge Alejandro the Fifth Circuit should never have examined the constitutional question because HERA’s shareholder succession should have blocked the Collins Plaintiffs lawsuit. Treasury also alerts Judge Alejandro that the Collins Plaintiffs have asked the High Court to review the Fifth Circuit’s decision.
