The government delivered a copy of a decision from the Sixth Circuit in Brott v. U.S. dated May 31, 2017, to the Fifth Circuit this past week. In that case, the Sixth Circuit told a group of 23 landowners that the Tucker Act is constitutional, they are not entitled to a jury trial (unless they want to reduce their claims to $10,000), and the Court of Federal Claims is the only tribunal with authority to award them compensation for the land that was taken from them for a public recreational purpose.
