Treasury points the Sixth Circuit panel to HERA’s anti-injunction and shareholder succession provision as reasons to reject Ms. Robinson’s appeal, and argues that Treasury did nothing improper when it entered into the Third Amendment. FHFA filed its brief this evening in the Sixth Circuit opposing Ms. Robinson’s challenge of the Net Worth Sweep. FHFA tells the Sixth Circuit stands on its tried and true “HERA says nobody can sue us” position, and is dismissive of Ms. Robinson’s other arguments.
