The government delivered its opposition to the D.C. Circuit yesterday to Perry and Fairholme’s request to take judicial notice of various documents Judge Sweeney unsealed last month. The government wants the D.C. Circuit to ignore the documents Perry and Fairholme provide. “Treasury’s motives are irrelevant to the question whether HERA’s broad anti-injunction and transfer-of-shareholder rights provisions bar plaintiffs’ suit,” the government’s lawyers say. It’s not hard to predict that we’ll see a reply from Perry and Fairholme within the next week or two.
