Yesterday, one of the lawyers for the Saxton Plaintiffs filed a notice of appearance (Doc. 266) in Fairholme v. U.S. This afternoon, Judge Sweeney entered an order (Doc. 267) striking that filing because the lawyer doesn’t doesn’t represent any party in Fairholme v. U.S.

Judge Sweeney’s action has no affect on her earlier ruling (Doc. 265) that the Saxton Plaintiffs’ lawyers have permission to access the confidential discovery materials Fairholme lodge with the Court in Iowa.
The lawyers representing the Class Plaintiffs filed their application this afternoon to obtain access to the confidential discovery materials lodged by Fairholme in Perry v. Lew pending before the D.C. Circuit. A copy of the application is attached to this e-mail message. According to the application, the government objects to the Class Plaintiffs’ request. 13-465-0268
